Support Issues, Canceling or Unsubscribing:

You have the option to opt out of the Empowered Living Hacks Club service at any time by sending a text message with the keywords STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to {Insert Program Code}. Message and data rates may apply. Alternatively, you can email [email protected] using your mobile phone number as the subject line. Message frequency is based on account activity.

Ownership; Trademarks; Modifications to Offers:

By agreeing to these terms, you acknowledge that Empowered Living Hacks or its partners hold all legal rights, titles, and interests in the Empowered Living Hacks Club services and any offers provided through the Empowered Living Hacks Club services, including any associated intellectual property rights. You agree not to modify any offers made through the Empowered Living Hacks Club service, and not to remove, obscure, or alter any proprietary rights notices (including copyright or trademark notices) affixed to the Empowered Living Hacks Club services or offers. Unless expressly authorized by a partner, you agree not to use any Trademarks (service marks, trade names, or logos) of any entity in a way that may cause confusion regarding ownership or be detrimental to the goodwill associated with such Trademarks.

Termination:

Empowered Living Hacks reserves the right, at its sole discretion, to terminate your subscription at any time without notice or future obligation.

Disclaimer of Warranties:

Empowered Living Hacks provides no warranties, express or implied, regarding the Empowered Living Hacks Club service. The service is provided “as is” and “as available,” and Empowered Living Hacks DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Factors beyond the control of Empowered Living Hacks, such as the speed of mobile carrier networks and the internet, may impact the service’s performance. Empowered Living Hacks is not responsible for any acts beyond its control.

Limitation of Liability:

Under no circumstances will Empowered Living Hacks, its officers, directors, employees, or agents be liable to you for any damages arising from your use of the Empowered Living Hacks Club service. This includes, but is not limited to, direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If any disclaimer or limitation on damages or liability set forth herein is prohibited by applicable law in a particular circumstance, Empowered Living Hacks will be entitled to the maximum disclaimers and/or limitations on damages and liability available under such applicable law. Notwithstanding the foregoing, in no event will Empowered Living Hacks be liable for any damages or liability arising under these terms of use or your use of the Empowered Living Hacks Club service that exceeds US $500.

Indemnity:

You agree to indemnify and hold harmless each party associated with Empowered Living Hacks from any claim, demand, damages, costs, or expenses, including reasonable attorneys’ fees and costs, arising from your breach of this agreement or the referenced documents, or your violation of any law or the rights of another party.

Governing Law; Venue:

This agreement, including its validity, construction, and performance, will be governed by the laws of the state of Colorado, without regard to its choice of law provisions. You agree to accept the exclusive personal jurisdiction of the state and federal courts of Colorado and waive any objections to the venue of such courts.
